Terms and conditions of use
ARTICLE 1 – PURPOSE AND SCOPE
HUUTY, operated by HUUTY and Co S.R.L., located at Leuvensesteenweg 246 Box 1, 1932 Zaventem and registered with the Crossroads Bank for Enterprises under number 0805.645.673, is subject to these General Terms of Use (hereinafter referred to as the “GTU”), which define the contractual relations between HUUTY and the platform users. HUUTY is an innovative digital platform specifically designed for the rental of friendly spaces between individuals for daytime use in Belgium. Our mission is to facilitate the connection between Owners of unique spaces and Tenants looking for venues for special occasions, meetings, or leisure activities.
As a matchmaking platform, HUUTY provides an online space where Owners can list their available spaces, and Tenants can discover and book them.
We are committed to providing an intuitive and secure User experience for all.
HUUTY acts as an intermediary, facilitating interactions and transactions between Owners and Tenants. Although we manage secure payments and collect commissions, our role is limited to that of a facilitator; rental contracts are concluded directly between the Users.
We are committed to making the rental of spaces as smooth and enjoyable as possible while ensuring high standards of trust and security. HUUTY endeavors to verify user information, but the ultimate responsibility for the quality of spaces and compliance with rental agreements lies with the users.
By using HUUTY, you agree to these terms of use and acknowledge understanding HUUTY’s role as described above.
The GTU prevail over any other agreement, unless otherwise agreed in writing by us. HUUTY reserves the right to modify the GTU, with the applicable conditions being those in effect at the time of the creation of the user account.
ARTICLE 2 – DEFINITIONS
HUUTY: an online platform operated by HUUTY and Co S.R.L., located at 1070 Anderlecht, Avenue Victor Olivier 10 box 25 and registered with the Crossroads Bank for Enterprises under number 0805.645.673, which allows owners to offer rental spaces, such as accommodations, rooms, gardens, swimming pools, commercial spaces, and other types of spaces, to potential tenants. Platform users can search, post, book, and manage Rentals through its features.
Owner: User of the HUUTY platform who offers one or more spaces for Rental. An owner is responsible for posting Listings corresponding to their spaces, providing detailed descriptions, photographs, and any relevant information related to the Rental. Owners are also responsible for complying with applicable local laws and regulations regarding space rental, as well as managing bookings and communicating with tenants.
Tenant: User of the HUUTY platform who searches for and reserves spaces for temporary use. Tenants are responsible for choosing spaces that meet their needs, complying with the Rental conditions established by the owners, and maintaining the space in the same condition as they found it. Tenants must also adhere to all rules and policies defined by the owner and HUUTY during their stay.
User: any person who uses the Services provided by HUUTY, whether as an Owner and/or Tenant.
Service: Offer provided by HUUTY, including the matchmaking between Owners and potential Tenants, as well as the provision of a messaging system. These services allow users to discover, book, and rent spaces on the platform, while facilitating communication between them.
Rental: Transactions or rental agreements concluded between Owners and Tenants via the HUUTY platform. This includes the reservation of spaces such as accommodations, offices, etc., for a specified period.
Rental Space: Real estate, whether it be an entire property, accommodation, individual room, garden, swimming pool, or other type of property, made available by Owners on the HUUTY platform for rent by Tenants. These spaces can be rented for various needs, including temporary stays, special events, business meetings, vacations, and many other occasions.
Listing: Publication created by an Owner on the platform to describe a Rental Space they wish to make available. This publication includes detailed information about the space, such as its description, features, Rental conditions, rates, as well as representative photos.
ARTICLE 3 – ACCESS AND REGISTRATION CONDITIONS ON HUUTY
Legal Capacity
Users must be at least 18 years old and have legal capacity to access HUUTY, use it, or create an account.
By accessing or using HUUTY, Users certify that they are at least 18 years old and have the legal capacity to enter into a contract.
Owner Account
The Owner must create an account to access and use HUUTY Services by following the procedure on the site.
Creating the Owner account will involve providing the following information:
Tenant Account
The Tenant must create an account to access and use HUUTY Services by following the procedure on the site.
- Username;
- Last Name;
- First Name;
- Email;
- Password expressly created to access their account;
- Copy of valid ID card
Creating the Tenant account will involve providing the following information:
- Username;
- Last Name;
- First Name;
- Email;
- Password expressly created to access their account;
- Copy of valid ID card
ARTICLE 4 – USE OF HUUTY
Owner Listing
The Owner using HUUTY assumes full responsibility for creating and updating their Listings. Each Listing must include a detailed description of the Rental Space offered, specify the Rental conditions, and comply with all regulations and laws in force.
It is imperative that Listings published by the Owner accurately reflect the reality of the Rental Space offered. They must include clear information about available options, amenities offered, and be complemented by representative photographs of the Rental Space.
Tenant Reviews and Ratings
Tenants have the opportunity to leave reviews on Rental Spaces they have rented. These reviews are presented in the form of star ratings, up to five stars. The Tenant can also include written descriptions of their experience, providing valuable feedback for future Tenants and Owners.
Messaging Service
HUUTY provides a direct messaging service that offers a structured platform for exchanges between Owners and Tenants. This system allows for maintaining a detailed and organized communication thread, conducive to addressing questions, discussing Rental specifics, and sharing essential information.
Unlike live chat, this messaging service does not claim immediacy but ensures continuous and monitored interaction. Owners as well as Tenants can send messages through this feature to exchange thoughtfully and documentedly.
The messaging service is accessible 24 hours a day, 7 days a week, ensuring that Owners and Tenants can communicate at any time that suits them. This allows for maximum flexibility in planning and coordinating Rentals.
We encourage Owners to be responsive to Tenant requests and questions via the messaging service. Similarly, we encourage Tenants to use this channel to obtain information quickly and easily.
Payments
Rental-related payments are fully managed by HUUTY.
In our role as facilitator, we ensure the security and compliance of these transactions, while charging commissions in accordance with our pricing policy.
To offer more flexibility and convenience, HUUTY accepts several payment methods. Users can settle their transactions via Paypal, Visa, Mastercard, and Bancontact. We are committed to providing a secure and efficient payment process for all our users.
Notification
Notwithstanding exclusions from liability of HUUTY and Co S.R.L. expressly provided for in Article 8, any User who becomes aware of a breach of the GTU and/or a breach of the laws and regulations in force by another User is invited to notify HUUTY by clicking on the “Suspicious Listing?” link found on each Listing and following the procedure indicated.
Deletion of the User Account
The User can permanently delete their account at any time, as of right and without any particular formality. All account information will be deleted as soon as possible in a total and definitive manner.
Account Deletion by HUUTY
HUUTY reserves the right to delete a User’s account – discretely – and without notice in the event of a breach of the obligations contained in these GTU. As soon as the account is deleted, an email will be sent to the User. The deletion of the account will not prevent HUUTY and Co S.R.L. from taking legal action against the User if necessary.
ARTICLE 5 – PRICING
HUUTY applies fees in the form of commissions to facilitate Rental between Owners and Tenants through its platform.
The commission structure is as follows:
For Owners: A commission of 3% of the Rental price is deducted from the total amount received by the Owner. This commission is the remuneration for HUUTY’s Services, and it will be deducted at the end of the rental period. For Tenants: In addition to the Rental price set by the Owner, Tenants are subject to an additional commission of 12% on the total amount of the Rental. This commission covers service and transaction fees provided by HUUTY and will be deducted at the end of the rental period.
Therefore, Owners receive the rental amount minus the 3% commission, while Tenants pay the total rental price plus the 12% commission.
VAT, applicable according to the legislation in force, may be added to these fees. If applicable, it is included directly in the commissions collected by HUUTY and Co S.R.L..
ARTICLE 6 – CANCELLATION POLICY FOR TENANTS
At HUUTY, we understand that sometimes, unforeseen events can occur, and plans may change. To ensure a fair experience for Tenants, we have implemented clear and transparent cancellation policies.
Cancellation 5 days before the start date of the booking:
If a Tenant chooses this option and cancels their reservation at least 5 days before the scheduled start date, they will receive a full refund of the total amount of the reservation. This allows the Tenant to plan their stay with confidence.
Cancellation made less than 5 days before the start date of the reservation:
In case of cancellation by the Tenant less than 5 days before the scheduled start date, the Owner will retain 40% of the total amount of the reservation, while the Tenant will receive a refund of 60%.
Cancellation 24 hours before the start date of the reservation:
If the Tenant cancels their reservation up to 24 hours before the scheduled start date and the Owner has checked this refund request option, the Tenant will receive a full refund without additional fees.
ARTICLE 7 – OBLIGATIONS AND RESPONSIBILITIES
Responsibilities of HUUTY
HUUTY and Co S.R.L., as a technical intermediary between Owners and Tenants, is bound by an obligation of means.
Our website is accessible 24/7, except in the event of interruption for maintenance or force majeure situations. We are committed to using all necessary means to maintain the high quality of our Services.
User Responsibility
The User must provide accurate and up-to-date information, particularly regarding their identity. They bear full responsibility for their actions on the site, including the content posted. This content must comply with all laws and regulations in force, not infringe on the rights of third parties, and not contain defamatory or harmful messages.
The User also undertakes not to disseminate false or misleading information likely to mislead HUUTY, other Users, or third parties. They acknowledge and accept their responsibility in case of damage caused to other Users, third parties, or HUUTY and Co S.R.L..
Specific Owner Responsibility
The Owner must ensure compliance with all applicable local laws and regulations for their services. This includes obtaining necessary authorizations, registering with the relevant authorities, and complying with safety and hygiene standards.
They must be aware that non-compliance with these regulations may lead to legal consequences and affect their ability to offer services on HUUTY.
Specific Tenant Responsibility
The Tenant is responsible for maintaining Rental Spaces in the condition they found them. They must respect the Owner’s property and personal belongings and assume financial responsibility for any damage caused during their stay.
The Tenant must also adhere to all rules and policies established by the Owners and HUUTY to ensure a smooth experience for all parties involved.
ARTICLE 8 – EXCLUSION OF LIABILITY OF HUUTY
Operation of HUUTY
HUUTY does not guarantee uninterrupted operation or permanent accessibility of its website. We shall not be liable for service interruptions, whether scheduled for maintenance or due to unforeseen circumstances. Furthermore, HUUTY cannot be held responsible for any damage resulting from the use or inaccessibility of the site, including data loss.
Responsibility Regarding Matchmaking
HUUTY does not guarantee that Owners will find Tenants for their Rental Spaces, nor that Tenants will necessarily book the proposed Rental Spaces. As an intermediary, our responsibility does not extend to the success of matchmaking or reservations made on the platform.
Reliability of User Information and Content
HUUTY is not responsible for incomplete or erroneous information provided by Owners or Tenants. Although we facilitate matchmaking, verifying the reliability of Rental Spaces and information provided is the responsibility of Users. HUUTY does not verify the content uploaded by Users and is not responsible for the information they publish.
Responsibility in User Relations
Users are solely responsible for the contractual or non-contractual relationships that develop between them via the site. HUUTY and Co S.R.L. does not intervene in determining the essential elements of contracts, such as characteristics, prices, or dates. Consequently, HUUTY and Co S.R.L. is not a party to contracts that may arise between Users. Therefore, HUUTY and Co S.R.L. cannot be held responsible for any failure related to the performance or improper performance of these contracts, nor for any direct or indirect, material or immaterial damage resulting from relationships between Users.
ARTICLE 9 – FORCE MAJEURE
Exemption in Case of Force Majeure
HUUTY and Co S.R.L. will not be held liable for any delay or failure in the performance of its obligations if such delays or failures are caused by events or circumstances beyond its reasonable control. These events include, but are not limited to, ‘force majeure’ cases such as earthquakes, floods, labor disputes involving third parties, restrictions imposed by public utilities, power outages, explosions, civil unrest, vandalism, riots, wars, and other similar events.
Efforts to Minimize Damages
In the event of a force majeure situation, HUUTY and Co S.R.L. undertakes to make all reasonable efforts to minimize the impacts and damages resulting from such events. We aim to resume our normal operations and services as soon as possible after the resolution of these situations.
ARTICLE 10 – ABSENCE OF INSURANCE PROVIDED BY HUUTY
HUUTY and Co S.R.L. does not provide insurance for Rentals. Therefore, it is the responsibility of Users, whether Owners or Tenants, to ensure that they have appropriate coverage for their specific needs.
ARTICLE 11 – INSURANCE FOR OWNERS AND TENANTS
To ensure a secure and worry-free experience on HUUTY, we strongly recommend both Owners and Tenants to take out appropriate insurance. This insurance can protect you in case of unforeseen events and offer peace of mind when renting Rental Spaces.
- Insurance for Owners: Owners are encouraged to check their existing insurance policies to ensure they cover potential damages or liabilities related to the Rental of their Rental Spaces. You may also consider taking out additional insurance for increased protection.
- Insurance for Tenants: Similarly, Tenants are encouraged to take out travel insurance or liability insurance to cover potential incidents during their stay. This step can protect you financially in case of reservation cancellation, accidental damages, or other unforeseen situations.
ARTICLE 12 – INTELLECTUAL PROPERTY RIGHTS
HUUTY and Co S.R.L. holds full, complete, and exclusive intellectual property rights over the content of HUUTY (such as trademarks, logos, designs, abbreviations, slogans, images, etc.), with the exception of intellectual property rights resulting from content created by the User through the use of the Services.
Any total or partial reproduction of HUUTY is strictly prohibited.
Any act of exploitation of these elements, in whole or in part, constitutes counterfeiting and may incur civil and criminal liability on the part of its author.
ARTICLE 13 – PROCESSING OF PERSONAL DATA
HUUTY and Co S.R.L. may be required to process Users’ personal data in compliance with applicable law.

ARTICLE 14 – APPLICABLE LAW AND JURISDICTIONS
The GTU are subject to Belgian law. Any dispute concerning their interpretation and/or execution falls within the jurisdiction of the Belgian courts.
ARTICLE 15 – FINAL PROVISIONS
The fact that HUUTY and Co S.R.L. does not avail itself, at any time, of any of the provisions of the GTU shall not be interpreted as a waiver by the latter to avail itself of them later.
The nullity or unenforceability of any provision of the GTU does not affect the validity of the other provisions, which remain fully valid.
